Terms of Service
Effective date: July 7, 2026
1. Agreement
These terms are an agreement between you (the company subscribing to Orbit and its authorized users) and DayTay Inc ("Orbit", "we"). By creating an account or using crm-orbit.com, you agree to these terms and to our Privacy Policy.
2. Your account
You are responsible for your team's credentials and for all activity under your accounts. Keep your login information secure and notify us promptly of any unauthorized use. You must provide accurate information and be authorized to act for the company you register.
3. Subscriptions & billing
Paid plans are billed in advance through Stripe on a monthly or annual cycle and renew automatically until canceled. Trials convert to paid plans at the end of the trial period unless canceled first. You can change or cancel your plan at any time from Settings → Subscriptions; cancellation stops future renewals and your plan remains active through the end of the paid period. Fees are non-refundable except where required by law.
4. Your data
The business records your team creates in Orbit — customers, jobs, proposals, invoices, photos, documents — belong to you. You grant us the limited rights needed to host, process, back up, and display that data to operate the service. We handle personal information as described in the Privacy Policy, and our use of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements.
5. Acceptable use
You agree not to misuse the service. Among other things, you will not:
- break the law, infringe others' rights, or send spam or deceptive messages through Orbit;
- probe, disrupt, or attempt to gain unauthorized access to the service or other customers' data;
- resell or white-label the service without a written agreement with us;
- upload malicious code or use the service to store or transmit it.
6. Third-party services
Orbit integrates with third-party services you choose to connect — such as Google Calendar, QuickBooks Online, Stripe, and material suppliers. Those services are governed by their own terms and privacy policies, and we are not responsible for them. You can disconnect an integration at any time.
7. Intellectual property
Orbit, including its software, design, and branding, is owned by DayTay Inc and protected by law. These terms do not grant you any rights to our brand or software other than the right to use the service while your subscription is active.
8. Disclaimers
The service is provided "as is" without warranties of any kind, express or implied. Estimates, measurements, and AI-generated outputs are aids, not guarantees — verify figures before relying on them in bids, contracts, or insurance claims. We do not warrant that the service will be uninterrupted or error-free.
9. Limitation of liability
To the maximum extent permitted by law, DayTay Inc will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the service is limited to the amounts you paid us in the twelve months before the event giving rise to the claim.
10. Termination
You may stop using the service at any time. We may suspend or terminate accounts that violate these terms or create risk for the service or other customers, with notice where practicable. Sections 4 and 7–11 survive termination.
11. General
These terms are governed by the laws of the State of Utah, USA, excluding its conflict-of-law rules. If we make material changes to these terms we will update this page, revise the effective date, and notify account owners of significant changes.
